Terms of Service

Effective date: July 2, 2026

These Terms of Service (the “Terms”) are an agreement between you and Emouna LLC, the operator of Zaduky (“Zaduky,” “we,” “us”), governing your use of the zaduky.com website, application, and related services (the “Service”). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Zaduky is a managed content engine: it researches search demand, generates interactive SEO content (“playbooks,” articles, and related assets) using artificial intelligence included with your plan, applies quality and compliance screening, and publishes to sites you configure. Features may change as the Service evolves; we will not materially reduce the core functionality of a paid plan mid-term without notice.

2. Accounts

You must provide a valid email address and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old and able to form a binding contract. One account per customer unless we agree otherwise in writing.

3. Subscription, billing, and automatic renewal

The Zaduky plan is $97 per month (USD), billed monthly on a recurring basis until you cancel. New customers may start on an intro offer: $3 charged today for your first month of full access, after which the subscription automatically renews at $97 per month (the first renewal is charged about 30 days after signup) unless you cancel. Alternatively, an annual plan of $970 per year (USD) is available (about two months free versus monthly), charged today and renewing automatically each year unless you cancel. Where no intro offer applies, $97 is charged immediately at signup and renews monthly. Your plan includes a monthly allowance of 50 content credits (1 credit publishes a standard piece; longer pieces use 2–3 credits by length). Optional prepaid credit packs are one-time purchases (Starter $29 / 25, Growth $79 / 80, Scale $199 / 225) whose credits do not expire and are consumed after your monthly allowance. Your plan includes unlimited sites and 3 custom domains; each additional custom domain is a $29 per month recurring add-on to your subscription, prorated by Stripe and removable at any time from Billing → Manage subscription.

Payments are processed by Stripe; we do not store your card details. Prices exclude any applicable taxes, which may be added where required by law. We may change pricing with at least 30 days’ advance notice; changes apply from your next billing period, and you may cancel before they take effect. These automatic-renewal disclosures are made consistent with Florida’s automatic-renewal statute (Fla. Stat. §501.165) and, for residents of states with their own automatic-renewal laws (such as California), those laws as well.

4. Cancellation, 3-day money-back guarantee, and refunds

You can cancel online at any time from Billing → Manage subscription (the Stripe customer portal) — no phone call or email required. A standard cancellation takes effect at the end of the current billing period: you keep access until then, are not charged again, and no refund is issued for the current period (except where required by law).

3-day money-back guarantee. Within 3 days (72 hours) of your initial subscription payment, you may request a refund directly from your Billing page. We will refund 80% of that payment and retain a 20% non-refundable administrative fee (for example, on a $97 charge you receive $77.60 and we retain $19.40). Submitting the request immediately and permanently cancels your subscription and ends your access; the refund is issued to your original payment method (typically 5–10 business days). The guarantee applies once per customer, to the first subscription payment only. After the 3-day window, subscription payments are non-refundable except where required by law.

Prepaid generation packs are one-time purchases and are not covered by the 3-day guarantee. They are non-refundable once any of their credits have been used; an entirely unused pack may be refunded within 14 days of purchase on request to support@zaduky.com. After cancellation your data is retained and re-accessible if you resubscribe (see the Privacy Policy for retention details).

5. Fair use of managed generation

Generation runs on Zaduky’s own AI provider accounts. Allowances and credits are per workspace and may not be resold, pooled across accounts, or consumed by automated abuse. We may throttle or suspend usage that degrades the Service for others or that attempts to circumvent metering.

6. Your content and sites

You retain ownership of the niches, offers, prompts, and configurations you provide and of the content the Service generates for your workspace, to the extent permitted by law. You grant us the license needed to host, process, publish, and display that content in order to operate the Service. You are responsible for the domains you connect and for having the rights to any material you supply.

7. Acceptable use and publishing compliance

You agree not to use the Service to:

  • publish unlawful, deceptive, or infringing content, or content you lack rights to;
  • fabricate testimonials, reviews, first-hand experience, product testing, scarcity, or results;
  • make earnings or income claims without substantiation;
  • remove or defeat required affiliate disclosures, sponsored-link attributes, or the Service’s quality and compliance gates;
  • probe, disrupt, or overload the Service, or access another customer’s workspace.

You are the publisher of your sites. You are responsible for complying with the laws that apply to your content and offers — including FTC endorsement and disclosure rules for affiliate links and any obligations specific to your niche (health, finance, and similar topics require particular care). The Service’s built-in gates help, but they do not replace your own judgment or legal obligations.

8. Our intellectual property

The Service — including its software, design, models’ orchestration, templates, and branding — is owned by Emouna LLC or its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while subscribed. You may not copy, resell, or reverse-engineer the Service.

9. Third-party services

The Service depends on third-party providers (including Stripe for payments, Supabase for authentication and data, Vercel for hosting, Resend for email, and a third-party AI provider for AI generation). Their availability affects ours; we are not liable for interruptions caused by third-party outages beyond our reasonable control.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED CONTENT MAY CONTAIN ERRORS — REVIEW IT BEFORE RELYING ON IT. WE DO NOT GUARANTEE SEARCH RANKINGS, TRAFFIC, CONVERSIONS, OR ANY LEVEL OF EARNINGS. TESTIMONIALS OR EXAMPLES, WHERE SHOWN, ARE NOT PROMISES OF YOUR RESULTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMOUNA LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Indemnification

You will defend and indemnify Emouna LLC against claims arising from your content, your sites and offers, your violation of these Terms, or your violation of law or third-party rights.

13. Suspension and termination

We may suspend or terminate accounts that violate these Terms, create legal risk, or fail to pay. You may stop using the Service at any time; Section 4 governs billing on cancellation. Sections that by their nature survive (ownership, disclaimers, liability limits, indemnity, governing law) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Courts located in Florida have exclusive jurisdiction over disputes arising from these Terms or the Service, and each party consents to personal jurisdiction there. Nothing in these Terms limits rights you may have under the consumer-protection law of your state of residence that cannot be waived by contract (including, for California residents, non-waivable rights under California law).

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect; the “Effective date” above always reflects the current version. Continued use after the effective date is acceptance of the updated Terms.
